We have an experienced staff for handling cargo claims on behalf of the Clubs/Owners/Charterers, dedicated to strengthen shipowners/charterers’ defense from the very outset of our attendance, i.e. as from time of survey up to completion of out of court discussions with cargo interests.
When the cargo claim arrives, most of the time several months after issuance of security, we review all supporting documents and assess the merits of the claim with the purpose of negotiating same on an amicable basis with cargo interests and on best possible terms. This save high legal costs, especially when the governing charter party gives jurisdiction to London arbitrators, which represents almost 95% of the claims we handle. One of our specialties is to handle rice claims (bulk or bagged cargo) and our attendance allows our clients to save the important legal costs that any proceedings in London automatically generate.
We feel comfortable discussing with cargo recovery agents, European cargo underwriters or directly with local receivers on the West African Coast when the latter are self-insured.
We are available to assist with any cargo claim (bulk cargo/bagged cargo/containers). Our local representatives are also in a position to assist when the time comes to discuss amicably with local Customs or Port State Control authorities when the latter impose a fine on the vessel for alleged deficit to the manifest or alleged vessel’s deficiencies.
