We have an experienced staff for handling cargo claims on behalf of the Clubs/Owners/Charterers, dedicated to strengthen shipowners/charterers’ defense from the very outset of our attendance, i.e. as from time of survey up to completion of out of court discussions with cargo interests.

 

When the cargo claim arrives, most of the time several months after issuance of security, we review all supporting documents and assess the merits of the claim with the purpose of negotiating same on an amicable basis with cargo interests and on best possible terms. This save high legal costs, especially when the governing charter party gives jurisdiction to London arbitrators, which represents almost 95% of the claims we handle. One of our specialties is to handle rice claims (bulk or bagged cargo) and our attendance allows our clients to save the important legal costs that any proceedings in London automatically generate.

 

We feel comfortable discussing with cargo recovery agents, European cargo underwriters or directly with local receivers on the West African Coast when the latter are self-insured.

 

We are available to assist with any cargo claim (bulk cargo/bagged cargo/containers). Our local representatives are also in a position to assist when the time comes to discuss amicably with local Customs or Port State Control authorities when the latter impose a fine on the vessel for alleged deficit to the manifest or alleged vessel’s deficiencies.

Personal injuries due to work related accidents or sickness, RTA etc… open rights for the injured person and heavy obligations for the employer or liable third party.

Our specialized team is familiar with the assessment of reasonable insurance compensation due to injured or sick individual or staff personnel in accordance with their employment contract or the applicable Collective Bargaining Agreement. We are used to analyzing such cases depending on the various applicable laws, either in France or on the African continent. We can estimate the entitlements and risks, reduce delays and initiate discussions in an efficient way in order to smooth what can often be difficult and tense situations and to push for a satisfactory and prompt outcome.
We can also handle claims for personal injuries presented by passengers or stevedores or assist domestic accidents.

CLAIMS UNDER ICA

Once a cargo claim has been negotiated amicably with cargo interests, we are at your disposal to conduct a recovery action against time charterers under the Inter Club Agreement (ICA) in order to obtain Charterers’ contribution to the claim settled. RIVER TRANSPORT

The various ports located on the River Rhone give direct access to the ports of Marseille/Fos and Sète or to railways giving access to Northern Europe.

We have experience in handling incidents which occur on the River Rhone and which involve CNR (Companie Nationale du Rhone), the French National Company in charge of managing navigation on the river.

We have recently handled claims for damages to buoys/markers or damage to locks at Port Saint Louis du Rhône. Once the surveys have been completed, we thoroughly checked the repair estimates provided and successfully discussed with CNR’s legal department to negotiate an out of court settlement.
